Colorado Springs Utilities (Utilities) offers Establishment Permits for customers who plan to install new landscaping with overhead irrigation and require more watering time than allowed per requirements of the Water Shortage Ordinance (WSO), Chapter 12, Article 4, Part 13 of the Code of the City of Colorado Springs. An Establishment Permit will provide temporary relief from time of day and number of days a week WSO water limits but will not provide exemption from the other requirements of the WSO. The intent of an Establishment Permit is to achieve water savings goals while giving customers the flexibility they need to establish new landscaping. Upon written approval of an Establishment Permit, the water customer agrees to follow the terms and conditions set forth in this application and any terms and conditions set forth in the approved Establishment Permit.
Terms and Conditions
· Applicant: Applicants signature if other than Colorado Springs Utilities customer indicates authorization by the account holder at this premise to apply for this permit on their behalf.
· Fee: There are currently no fees for a​ permit.
· Water Rates: An establishment permit does not excuse customers from paying any applicable rates for water service.
· Applicability: An establishment permit will only be issued for one premise and is only for the establishment of new landscaping. Established landscaping cannot be watered on an establishment permit unless watered by the same irrigation zone as the new landscaping.
· Multiple site applications: A commercial customer may provide one application for several premises provided all necessary details, including: applicable account numbers, addresses, project details and/or corresponding maps.
· Duration: Establishment permits for sod or plants are effective a maximum 28 days. Establishment permits for all seed projects are effective a maximum 42 days.
· Availability: Establishment permits are not available and will automatically expire during a declared Stage III or Stage IV water shortage.
· Soil Amendment Requirement: Proof of purchase of an approved organic soil amendment of at least four cubic yards for every 1,000 square feet of sod or non-native seed is required for an establishment permit. A receipt showing the amount purchased must be submitted with the application.
· Soil Amendment Tilling: Amendment must be incorporated into the soil by tilling to a minimum depth of six inches where possible.
o Test results must be dated within the previous 12 months.
o Test results must demonstrate that soil’s organic matter content exceeds three percent (or demonstration that customer has followed the specific amendment recommendations in the soil test report).
o For test results with less than three percent soil organic matter content, contact the Establishment Permit Office to receive a custom soil amendment rate.
· Soil Amendment Exemption: is allowed for the seeding of native grasses and applying seed over existing grass; legible proof of purchase itemizing the native grass species purchased must be provided. Grass seed mixes must contain at least 60% by weight, native grass species. A list of qualified native seed and seed mixtures can be found at https://www.csu.org/Documents/GrassSeedMixes.pdf. · Signature: Applicants signature if other than Colorado Springs Utilities customer indicates authorization by the account holder at this premise to apply for this permit on their behalf.
· Site Inspection: Utilities may require and conduct a site inspection of the premise to evaluate adherence to the establishment permit terms and conditions. If Applicant refuses to allow a site inspection or if Applicant has not complied with the soil amendment terms and conditions, the establishment permit may be denied at Utilities’ sole discretion.
· Notice of Permit: A notice regarding the existence of an Establishment Permit shall be displayed on the premises and be visible from a public street at all times during the term of the Establishment Permit.
Any violation of these terms and conditions, or any other provision of the WSO will result in the immediate revocation of an establishment permit.

Colorado Public (Open) Records Act (CORA) - Utilities is an enterprise of the City of Colorado Springs, therefore, Colorado Springs Utilities’ records are public records open for inspection by any person at reasonable times, except as provided by the Colorado Public (Open) Records Act (CORA) or other laws. The CORA permits the denial of inspection of any records that contain personal and financial information of past or present users of public utilities.
