Note: Applicants to whom such products are provided are required to duly complete and execute the agreement provided on the reverse side of this form.

You will be notified when the maps are available. Please allow at least 24 hours for maps to be prepared.
Maps may be picked up at the Leon Young Service Center, 1521 S. Hancock Expressway, Colorado Springs, CO 80910.

The Applicant in accepting FIMS Information hereby acknowledges the limitations of such Information and the restrictions on its use:

1) The Information being provided is intended to comply with Colorado’s Open Records Act. The Information is protected by the copyright laws of the United States and is being furnished with all rights reserved. No part of the Information may be copied, reproduced or transmitted in any form or by any means whatsoever, including but not limited to electronic, mechanical, photocopying, recording, scanning, or by any information or retrieval system, without the expressed written permission of the City, as may be provided within this Agreement. The Applicant shall not license, sublicense, assign, release, publish, transfer, sell or otherwise make available any portion of the Information to a third party without the expressed written permission of the City as may be provided within this Agreement.

2) FIMS Information has been developed for internal use only, and the City makes no warranties or guarantees, either expressed or implied, as to the completeness, accuracy or correctness of such Information, nor accepts any liability arising from any incorrect, incomplete or misleading Information provided pursuant to this request. There are no warranties, either expressed or implied, of merchantability or fitness of such Information for a particular purpose;

3) The City is not responsible for incidental, consequential, or special damages arising out of the use of the Information provided the Applicant. The Applicant agrees that the Information shall be used and relied upon only at the risk of the Applicant. The Applicant agrees to indemnify and hold harmless the City, its officials, officers, employees and servants from any liability, claims, loss, damages, injury, costs and attorney fees arising out of procuring, compiling, collecting, interpreting, producing, using or communicating the Information relating to this request.

4) The Applicant agrees at the time of request to pay the Colorado Springs Utilities the approved rates, shipping and handling costs, if any, and the required taxes relating to this request.

7) This Agreement embodies the entire agreement between the Applicant and the City. The parties shall not be bound by or liable for any statement, representation, promise, inducement, or understanding of any kind or motive not set forth herein. No additional charges, amendments, or modifications of any of the terms or conditions of the Agreement shall be valid unless reduced to writing and signed by the parties. This Agreement is not assignable under any circumstances whatsoever.
